Can you smoke weed in Puerto Rico in 2026? No. Not on a beach, not on a hotel balcony, and not with a medical card in your wallet. Puerto Rico runs a medical-only program, and the law behind it bans smoking cannabis for everyone, registered patients included. What the island does allow is narrower and more specific: registered patients and qualifying visitors, adults 21+ in nearly every case, can buy medical cannabis at licensed dispensaries and use it by non-combustion methods in private.
The confusion is understandable. Dispensaries here look like dispensaries anywhere, flower sits in the cases, and plenty of visitors arrive assuming the rules match their home state. They don't.
The short answer
There is no recreational cannabis in Puerto Rico. Possession without a medical authorization is still a crime under the island's controlled substances law, and buying from anyone other than a licensed dispensary is prohibited.
For people who do qualify, the law draws one bright line: no smoking. Article 9 of Ley 42-2017, the island's medical cannabis statute, says it plainly: "Se prohíbe terminantemente el consumo de cannabis mediante el acto de fumar." Smoking is strictly prohibited. Reglamento 9038, the Department of Health regulation that runs the program, repeats that nothing in it authorizes anyone to smoke cannabis.
Vaporizing is where the line sits
The statute separates smoking from vaporizing. It defines vaporizing as drawing out the active components with heat without starting combustion, and it bars the program from ever approving ignition or combustion as a method of use. Vaporization, by contrast, can be permitted.
Flower is the complicated part. Ley 42-2017 frames vaporizing flower as an exception the program's medical advisory body can authorize, written with terminal illness and cases without suitable alternatives in mind. In practice, flower is on Puerto Rico dispensary menus for registered patients whose recommendation covers it, sold for use in a vaporizer. The law has not changed on burning it. A pre-roll on a shelf is not a permission slip.
The other legal forms are the ones visitors tend to overlook: vape cartridges, oils, tinctures, capsules, edibles and topicals. For edibles, the usual rule applies: start low, go slow, and keep a first serving at 10 mg or less.
Who can buy at all
Two groups can walk into a licensed dispensary and leave with product.
Registered Puerto Rico patients. The Junta Reglamentadora del Cannabis Medicinal, part of the Departamento de Salud, issues patient identification after a recommendation from an authorized physician. Under Reglamento 9038, adult applicants must be 21 or older (or legally emancipated), the recommendation can be no more than six months old when submitted, and the registration runs for one year unless the recommendation sets a shorter term.
Patients from other US states. Ley 42-2017 counts residents of other states who hold a medical cannabis card issued by their home state, alongside a physician's recommendation, as patients. Dispensaries usually want to see a photo card, and they generally won't sell flower on an out-of-state card, so expect vape, edible, tincture and topical options rather than the flower case.
Visitors whose home state doesn't issue a card, or whose card lacks a photo, have a third route: a temporary Puerto Rico registration arranged through a certifying clinic. It exists, but its length, fee and turnaround are not spelled out in published regulation. Confirm all three with the clinic before paying. Anyone who fits none of these categories cannot buy legally in Puerto Rico, full stop.
Where use is allowed
The rule, plainly: Ley 42-2017 limits medical use to homes and private places, and prohibits it in public places. Reglamento 9038 fills in the edges. Patients may use cannabis in the privacy of their homes, at a workplace whose employer allows it, or in a private place whose owner allows it.
What it means for your trip:
- Beaches, streets, plazas and parks are public. Every beach on the island is open to the public, so none of them qualify.
- Dispensaries are off-limits. No use is allowed on a licensed premises.
- Commercial establishments are off-limits unless the owner authorizes it, and so-called vape lounges are prohibited outright.
- Events are off-limits. The statute bans consumption at conventions, exhibitions and public or private events.
- Federal property is off-limits. Reglamento 9038 prohibits use on property of the US government. That includes El Yunque National Forest and the forts of the San Juan National Historic Site in Old San Juan.
- Hotels and rentals are the owner's call. Many smoke-free policies cover vapor too. Read the listing, and if the answer isn't yes in writing, it's no.
Driving and boats
Driving under the influence of medical cannabis is illegal, and Reglamento 9038 extends that to boats and aircraft. A registered patient gets no exemption. The ferries to Vieques and Culebra, rental cars on the expressway and the winding roads into the central mountains all fall under the same rule.
Leaving the island
Reglamento 9038 prohibits taking medical cannabis from Puerto Rico to the mainland or any other jurisdiction, even to a state where it's legal. Federal law governs the airport. Anything bought here stays here.
Before you shop
The dispensary directory lists licensed locations across the island. Bring the card you plan to buy on plus a government photo ID with the same name, and call ahead if you're using an out-of-state card to ask what the shop will sell on it.
